Nicolás Maloberti is a Senior Fellow at Liberty Fund, Inc., a non-profit educational foundation. He earned his BA in Political Science from the University of Buenos Aires, his MA in Economics and Political Science from ESEADE, and his PhD in Philosophy from Bowling Green University. His work has appeared in journals such as Revista de Ciencia Política, The Independent Review, Rationality, Markets, and Morality, Revista de Institutions, Ideas, y Mercados, and The Journal of Value Inquiry. His current areas of research include the limits of markets and the implications of behavioral economics for the libertarian case for a minimal state.

Are Immigration Restrictions Required by Individual Rights?

It’s not uncommon to think of immigration restrictions in terms of individuals’ rights of association. In the same way that a private club has the right to select its members, the state has the right to select its residents — or so the thinking goes. The problem with this line of reasoning is that immigration restrictions actually curtail that very same right to decide with whom citizens associate, or trade. If we take individual rights seriously, then, we should understand immigration restrictions as rights infringements.
